Welcome to FightWell. These Terms of Service (“Terms”) are a legal agreement between you and FightWell LLC (“FightWell,” “we,” “us”) governing your use of the FightWell app and website (the “Service”). By creating an account or using the Service, you agree to these Terms. Please read them carefully, especially the “Not therapy” and “Limitation of liability” sections below.
FightWell is a couples conflict-resolution app that gives two partners a shared space to work through conflicts with the help of an AI Guide, Claire. The Service is a communication tool. It is not therapy, counseling, or any form of healthcare, and it does not create a therapist-client, counselor-client, or doctor-patient relationship of any kind.
If you are in crisis, don't wait on FightWell. If you or your partner are experiencing a mental health emergency, thoughts of suicide or self-harm, or a threat to your immediate safety, stop using the Service and contact emergency services (911 in the U.S.), or a crisis line — such as the 988 Suicide & Crisis Lifeline (call or text 988 in the U.S.) — right away. FightWell is not equipped to respond to emergencies and does not monitor conversations in real time.
No guaranteed outcome. FightWell is a tool to help you communicate — it cannot resolve your conflict for you, and using it is not a guarantee that your relationship will improve or that any particular outcome will result. Decisions you make about your relationship, based in whole or in part on anything said in the Service, are yours alone, and you assume full responsibility for them. FightWell LLC is not responsible for the outcome of your relationship or for any decisions, actions, or consequences resulting from your use of the Service.
You must be at least 18 years old to use FightWell. By using the Service, you confirm that you meet this requirement, that you have the legal capacity to enter into these Terms, and that the information you provide is accurate.
FightWell is currently free to use. We may in the future introduce paid subscription plans and/or usage limits (for example, a limit on the number of AI Guide responses available without a paid plan) — including for accounts created while the Service was free. We will give reasonable notice of any such change before it takes effect for your account; continuing to use the Service after that point constitutes acceptance of the change.

You retain ownership of the messages and content you create in FightWell. You grant us a limited license to store and process that content solely to operate and provide the Service to you and your partner — for example, to deliver messages and generate AI Guide responses. We do not sell your content and we do not use your private conversations for advertising. See our Privacy Policy for details on how we handle your data.
Within a shared space, each partner has private chats the other partner cannot read. You agree to use shared chats respectfully. We are not responsible for how you and your partner choose to communicate within the Service, or for any conflict, harm, or dispute that arises between you and your partner.
We may modify, suspend, or discontinue any part of the Service at any time. We may also update these Terms from time to time; when we do, we will revise the “Last updated” date above. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
You may stop using the Service and request deletion of your account at any time. We may suspend or terminate access if you violate these Terms or use the Service in a way that could harm others or the Service itself.
THE SERVICE, INCLUDING ALL CLAIRE OUTPUT, IS PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE, OR THAT CLAIRE'S RESPONSES WILL BE ACCURATE, COMPLETE, OR SUITABLE FOR YOUR SITUATION.
TO THE MAXIMUM EXTENT PERMITTED BY LAW: (A) FIGHTWELL LLC AND ITS OWNERS, EMPLOYEES, AND CONTRACTORS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, DATA, OR RELATIONSHIP OUTCOMES, ARISING FROM YOUR USE OF — OR INABILITY TO USE — THE SERVICE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES; AND (B) OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF (I) THE AMOUNT YOU PAID US, IF ANY, IN THE 12 MONTHS BEFORE THE CLAIM AROSE, OR (II) $100 USD. Some jurisdictions do not allow the exclusion or limitation of certain damages, so some of the above limitations may not apply to you.
You agree to indemnify and hold harmless FightWell LLC and its owners, employees, and contractors from any claims, damages, losses, and expenses (including reasonable legal fees) arising from your violation of these Terms or your misuse of the Service.
These Terms are governed by the laws of the State of Wyoming, without regard to conflict-of-laws principles. Any dispute arising out of or relating to these Terms or the Service will be brought exclusively in the state or federal courts located in Wyoming, and you consent to personal jurisdiction there.
